Our Terms and Conditions.

TERMS & CONDITIONS

Definitions

“Booking Fee” means the fee chargeable to cover the cost of postage and packaging

“Customer” means the individual or corporate entity who purchases the Driving Experience.

“Driving Experience” is the participation in or of one or more of the driving experiences described on the Mercedes-Benz World website (www.mercedes-benzworld.co.uk) and specified on the front of this order.

“Driving Experience Provider” is the individual or company that provides the Driving Experience at Mercedes-Benz World for and on behalf of Us, or their representative

“Mercedes-Benz World” means Mercedes-Benz World at Brooklands Drive, Weybridge KT13 0SL

“Our / We / Us” means Mercedes-Benz World

“Driver” means the individual intending to participate in a Driving Experience as driver

Passenger” means the individual(s) accompanying the Driver during a Driving Experience as a non-driver, if any. For the avoidance of doubt, an individual acting in the capacity of a Passenger is not entitled to drive the vehicle during the Driving Experience.

Participants” means any references to both the Driver and Passenger(s).

 

General Terms and Conditions

  1. Participants are required to arrive 30 minutes prior to their Driving Experience.
  2. Certain cars and/or Driving Experiences may be subject to, health, height and weight restrictions for safety reasons (including but not limited to any such restrictions referenced within these terms and conditions and on the Mercedes-Benz World website) and it is the responsibility of the Customer to ensure that all Participants are able to comply with this in order to avoid disappointment on the day. We reserve the right, in Our sole discretion, to deny any Participant the opportunity of taking part in a Driving Experience if it appears that they do not comply with such restrictions. Where We exercise Our discretion under this clause 2, the Customer(s) will be entitled to a refund, or alternatively and at Our discretion the Customer or Participant may on the day nominate another person to participate in the Driving Experience, provided that such person complies with such restrictions.
  3. Participants will be required to sign a risk acknowledgement prior to the Driving Experience confirming certain information and, in the absence of any negligence on Our part, accepting participation in the Driving Experience is at their own risk. A copy of the disclaimer is available on request.
  4. All Participants agree that where they are required to wear safety or protective equipment they will do so except where they are able to justify not doing so on medical or religious grounds. Where a Participant does evidence medical or religious grounds to justify not having to wear protective or safety equipment, it will be at Our discretion as to whether the Participant may still participate in the Driving Experience. Where We exercise Our discretion under this clause the Customer will be entitled to a full refund or alternatively and at Our discretion the Customer or Participant may on the day nominate another person to participate in the Driving Experience, provided that such person meets the relevant requirements.
  5. Participants will be required to follow all the instructions and directions given to them by the Driving Experience Provider and to complete any training required. We reserve the right to prevent Participants taking part in or completing the Driving Experience where they fail to comply with instructions of the Driving Experience Provider or complete any required training. We reserve the right to claim against the Participant for any damage caused due to their negligent actions. We reserve the absolute right, in Our sole discretion, to deny any Participant the opportunity of taking part in a Driving Experience if it appears that they are unfit to do so, this includes but is not limited to situations where the Participant appears to be under the influence of alcohol or drugs. Where We exercise Our discretion under this clause 5, the Customer(s) will not be entitled to a refund.
  6. Instructions and directions will be provided in English and Participants will need to be able to follow instructions and directions given to them in English by the Driving Experience Provider. Should the Driving Experience Provider reasonably consider that a Participant is unable to do so, they may be unable to complete the drive. Where We exercise Our discretion under this clause 6, the Customer(s) will be entitled to a refund, or alternatively and at Our discretion the Customer or Participant may on the day nominate another person to participate in the Driving Experience, provided that such person meets the relevant requirements.
  7. If the Driving Experience Provider reasonably considers a Driving Experience to be too physically or mentally demanding for the Participant, We reserve the right to organise or amend the Driving Experience as appropriate considering all the circumstances of the Driving Experience, including extreme weather conditions.
  8. All Customers and Participants consent to the filming and recording of their involvement in the Driving Experience for safety and training purposes. By doing so it is also agreed that the resulting footage can be used for the purposes of promoting Us and that the intellectual property rights of the footage are Our sole property. For the avoidance of doubt, if you are the Customer booking the Driving Experience, it is your responsibility to ensure that any other Participants who are a part of your booking, are made aware of such filming and recording taking place.
  9. All Customers and Participants shall have the option to purchase a recording of their Driving Experience. In the event that the Driving Experience fails to record, We will only refund the cost of the video recording that the Customer has paid for in advance of the Driving Experience.
  10. Due to the nature of the premises where the Driving Experience takes place, all Customers and Participants acknowledge and accept that the Driving Experience footage may be shown in a common area open and accessible by other individuals including but not limited to other Customers and Participant. Therefore, whilst We will use reasonable endeavour to limit visibility of the footage by others, we cannot guarantee this.
  11. You have the right to request a copy of the personal data we hold on you and to request that we rectify or erase (where lawfully permitted) this data at any time as well as your right to submit a complaint to us or the Information Commissioners Office. For a full list of your rights, please review the privacy policy. Our full Privacy Policy is published on our UK website which is www.mercedes-benz.co.uk/privacy and is also available on request.
  12. Full payment (inclusive of any taxes due and in the event of non-digital vouchers, the Booking Fee) must be made at the time of purchase of the Driving Experience. In the event any variations are made to the Driving Experience under clause 13, any additional sums will be payable by the Customer or Participant (as appropriate) immediately upon completion of the Driving Experience.
  13. We reserve the right to amend the price payable, where reasonable, for any variations made to the Driving Experience at the Customer´s or Participant´s request.
  14. We reserve the right to postpone a Driving Experience due to circumstances beyond Our reasonable control, including but not limited to adverse weather conditions which may affect Participants´ safety and incidents affecting transport and public safety. Decisions regarding adverse weather conditions can often only be made on the day of the Driving Experience. Notice will be given as soon as reasonably practicable. In the event a Driving Experience is postponed or cancelled, Customers may reschedule their Driving Experience within 12 months of postponement or cancellation by Us, subject to availability. We cannot accept liability for any costs or losses incurred by the Customer or Participant in this instance.
  15. We reserve the right to amend a Driving Experience should some of the facilities required become unavailable. Where the change is so material that the Driving Experience is no longer similar to that originally booked, the Customer or Participant will be entitled to reschedule another Driving Experience or alternatively the Customer may obtain a refund.
  16. We will endeavour to provide the cars as detailed in the Driving Experience, however, where such a car is not readily available We reserve the right to allocate the use of a different car, which is as close as possible in specification to that detailed in the Driving Experience. Where the change of car is so material that the Driving Experience is no longer similar to that originally booked, the Customer or Participant will be entitled to reschedule another Driving Experience or alternatively the Customer may obtain a refund.
  17. Mercedes-Benz World maintain third party and public liability insurance for all Driving Experiences.
  18. Participants in control of a car will be held liable for any damage whatsoever caused including but not limited to the car, track or Mercedes-Benz World property and premises up to a sum of £1500. Customers and/or Participants may purchase Accident Damage Protection (“ADP”) for the sum of £20 which will reduce the Participant’s liability to NIL. This can be purchased at the time of booking the Driving Experience or prior to taking part in the Driving Experience or on the day itself, save for Driving Experiences purchased by a Customer as part of a corporate package whereby ADP shall in all instances be included within the cost of the Driving Experience at the time of booking. In the event that the Participant is found to have acted deliberately, recklessly or negligently the ADP shall be void in all cases and the Participant will be liable to Mercedes-Benz World for any damage and costs caused.
  19. If any provision of these terms and conditions is found by any court, tribunal or administrative body of competent jurisdiction to be wholly or partly illegal, invalid, void, voidable, unenforceable or unreasonable it shall, to the extent of such illegality, invalidity, voidness, voidability, unenforceability or unreasonableness, be deemed severable and the remaining provisions of the terms and conditions and the remainder of such provision shall continue in full force and effect.
  20. These terms and conditions embody and set forth the entire agreement and understanding of all parties and supersede all prior oral or written agreements understandings or arrangements relating to the subject matter of these terms and conditions (the "Agreement"). No person other than a party to this Agreement shall be entitled to enforce any term of it save where an agreement is entered into pursuant to which any rights and/or obligation contained in this Agreement are assigned or novated to a third party. Nothing in this Condition shall, of itself, operate to prevent any such assignee from taking the benefit of, and enforcing, any rights so assigned.
  21. The contract for the purchase of the goods/services is governed by the laws of England and Wales and is subject to the exclusive jurisdiction of the English and Welsh Courts.

 

Driving Experiences

  1. 4x4 Experience duration includes briefing, tuition time and transport to and from Off-Road Terrain. Driving time may vary.
  2. Personal introduction to your professional driver, safety briefing, seat set up and transport to and from the dedicated driving area are part of the total duration of the Driving Experience
  3. All Drivers must produce a full UK or international driving licence. This clause 24 does not apply to Drive Mercedes-Benz Driving Experiences and Passenger rides.
  4. For the avoidance of doubt, no more than one Driver shall be permitted to participate in each Driving Experience.
  5. Participants of Drive Mercedes-Benz Driving Experiences must be over 1.5 metres tall. Personal introduction to your professional driver, safety briefing, seat set up and transport to and from the dedicated driving area are part of the total duration of the Driving Experience
  6. It is the responsibility of the Driver to ensure that where a Passenger is under 135cm in height and under 12 years of age, a suitable child car seat/booster seat in line with The Highway Code and any other applicable legislation is used by the Passenger(s) throughout the Driving Experience. For the avoidance of doubt, the Driver must provide the child car seat and correctly fit the seat to the vehicle, for use by the Passenger. In the event a suitable child car seat/booster seat has not been provided by the Driver for use by the Passenger in line with The Highway Code and any other applicable legislation, (or in certain circumstances such seat does not fit correctly to the vehicle seat), We reserve the right to prevent Passengers from taking part in the Driving Experience. We would advise contacting Mercedes-Benz World in advance of the Participants Driving Experience to make suitable arrangements for the purposes of this clause 27.
  7. Prices include VAT. Subject to change without notice.

 

Delivery (if applicable)

  1. Driving Experience vouchers will be delivered via email within 24 hours to the email address used at the time of booking. If the Driving Experience vouchers have not been delivered within 24 hours, please contact Us on 0370 400 4000. Where specifically requested, vouchers will be delivered to the delivery address shown on your order form.

Whilst we will try to deliver your order within 3-5 working days, you should allow up to 28 days for delivery If you require any special delivery requirements you should call us on 0370 400 4000 where we will advise you of availability and any additional costs. Whilst every effort is made to deliver you order in accordance with the time scales set out, we do not accept any liability for late delivery of any orders. Delivery to residences outside of the UK is unavailable. We apologise for any inconvenience.

 

Refunds and Amendments

  1. Gift vouchers and pre-booked Driving Experiences are non-refundable and any Driving Experiences should be redeemed within the duration of the gift voucher.
  2. We are unable to make any amendments to a Driving Experience booking within 7 days of the experience date. Any amendment to a Driving Experience booking, or a gift voucher, by a Customer or Participant is subject to Our approval and a reasonable administration fee. We reserve the right to refuse any amendment. Where an amendment is refused by Us the Customer will not be entitled to any refund. If the Driving Experience is booked in conjunction with conferencing facilities, the Minimum Number of Guests (as defined in the Conferencing and Banqueting Terms and Conditions) will be the minimum number charged for.

Where the Client is a consumer, nothing in these terms and conditions shall affect the Client’s statutory rights under the current Sale of Goods Act or the Unfair Contract Terms Act.
